CDL violations
Moving violations for the average driver usually mean increased insurance rates, costly tickets and even a temporary suspension of a driver's license. But when you drive for a living, these traffic tickets could mean losing your commercial driver's license (CDL) and your job.At the law firm of The Madison County Traffic Law Attorneys, we understand you make your living on the road. We will fight aggressively to keep you there. We have helped numerous in-state and out-of-state drivers keep their commercial driver's licenses by working to have citations reduced, dismissed or amended.
With high travel roadways through Madison County, we have assisted countless in-state and out of state clients with CDLs who have been issued traffic citations. We work diligently within the law to keep the citations off of your driving record by working to have your citation reduced, dismissed or amended to a non-moving violation. We understand you make a living on the road, and fight aggressively to keep you there.
DRIVING UNDER THE INFLUENCE
DUI charges don't have to ruin your life. You have a lot of options to defend your future and driving privileges - don't compound your situation by failing to secure experienced defense against your charges. Our attorneys have argued numerous cases successfully, attacking the validity of the officer's initial traffic stop and the procedures administered during your arrest. Many people don't understand that field sobriety and breathalyzer tests are often administered incorrectly. Our staff will thoroughly review all documents relating to your arrest, including police reports, witness testimony and all test results to find a weakness in the prosecution's case against you.
CONstruction zone - scott's law
CONSTRUCTION ZONE VIOLATIONS
The recent addition of photo radar and other automated enforcement systems has led to an increase in the number of construction zone tickets in the Metro East and throughout the Illinois River Bend. A large percentage of these tickets are issued for moving violations such as:
• Speeding• Using a cellphone (in Illinois)• Failure to yield• Failure to follow signage or detoursSpeeding and other traffic offenses committed while driving in a construction zone are considered more serious than those committed while in a standard traffic zone. If you are pulled over for one of these violations, or receive a photo enforcement traffic ticket in the mail, it is important to understand your rights and options. If you simply pay a traffic ticket, you are pleading guilty to the offense and a conviction will go on your driving record. As a result, you may be forced to pay a hefty fine, your insurance rates will likely increase and, depending on your history of past offenses, your driver's license may be suspended. If you hold a commercial driver's license (CDL), a citation for a construction zone moving violation could cost you your job, even if you were driving your personal vehicle at the time.
What Is Scott's Law?Often called the "Move Over Law," Scott's Law requires drivers to yield to moving emergency vehicles displaying flashing warning lights. The law also requires drivers to change lanes (if possible) or reduce speed and proceed with due caution when approaching a stationary emergency vehicle displaying flashing warning lights.Scott's Law was created in honor of Lieutenant Scott Gillen of the Chicago Fire Department, who was hit and killed in 2000 by a drunk motorist while assisting at a crash on the Dan Ryan Expressway in Illinois.Possible Punishment For Violating Scott's LawViolation of Scott's Law could result in a fine of up to $10,000. Conviction could also result in driver's license suspension under the following circumstances:• 90 days to one year if the violation results in damage to the property of another person• 180 days to two years if the violation results in injury to another person• Two years if the violation results in the death of another person
LICENSE SUSPENSION
If you face a possible driver's license suspension, you may not want to pay an attorney to handle a so-called "minor legal issue." The costs you face in the future, however, will far exceed any legal fees charged to you. If your license is suspended, you may have trouble getting to work, taking care of your children and carrying out your daily routine. A driver's license suspension may also dramatically increase your car insurance rates. If you have a CDL, you could lose your job and your livelihood.
